Materials excluded for disposal in a roll-off bin (herein referred to as âexcluded materialsâ) shall include but not be limited to hazardous waste, large amounts of concrete, bricks, tile, gravel, stone, rock, asphalt, metal beams (except as specifically disposed through the use of a separate 4 yard roll-off bin), industrial waste, chemical products, herbicides & pesticides, radioactive materials, solvents, paint, other flammable liquids, aerosol cans, propane tanks, engines, motors, oil filters, motor oil, transmission oil, lubricating oil, hydraulic oil, gasoline, antifreeze, large appliances, contaminated soil, tires, batteries, computers, monitors, televisions, microwaves, bathtubs, fluorescent tubes and light ballastsâ, railroad ties, medical waste, asbestos, animal carcasses, human feces, animal feces, barrels, âHard to Handleâ materials. Customer or agent shall not place any materials unacceptable to local landfill sites or in any way hazardous or potentially hazardous by designation under any Municipal, Provincial, Federal or other applicable laws or regulations.
Customer shall be responsible for and shall advise Mr. Waste of the location. Customer shall allow Mr. Waste to enter and leave the location in which the roll-off bin will be located. Customer warrants that Mr. Waste shall have access to the roll-off bin and other equipment as required to perform the services and the placement site shall be sufficient to bear the weight of such roll-off bins and equipment. The customer assumes all liability for the inability to access such roll-off bins and equipment as well as any damages to such sites, structures, facilities, surfaces, pavement, curbing, driveways, parking areas, yards, removable objects or personal property thereon.
Customer agrees to provide unobstructed access to any and all equipment on the date scheduled for access to Mr. Wasteâs equipment. If such equipment is inaccessible so that the scheduled services cannot be performed; Mr. Waste. will promptly notify the Customer and afford the Customer a reasonable opportunity to provide the access and reschedule the service, provided however, Mr. Waste will charge an additional fee for the Customerâs failure to provide initial access.
Any and all equipment by Mr. Waste shall remain the property of Mr. Waste; however, Customer acknowledges that it has custody and control of such equipment while at the Customerâs location and accepts responsibility for all loss for damage to the equipment (except for normal wear and tear or for loss or damages resulting from Mr. Waste handling of the equipment) and for its contents. Customer agrees not to overload (by weight or volume), move or alter the equipment, and shall use the equipment only for its proper and intended purpose. Customer agrees to indemnify, defend and hold harmless Mr. Waste against all claims, damages, suits, penalties, fines and liabilities for injury or death to persons or loss or damages to property arising out of Customerâs use, operation or procession of the equipment. Customer assumes responsibility and additional costs for off-loading overweight or over height containers as well as excluded materials.
Mr. Waste shall acquire title to conforming waste materials when such materials are placed into Mr. Waste roll-off bins and other equipment. Title to and liability for any excluded materials shall remain with Customer and Customer expressly agrees to defend, indemnify and hold harmless Mr. Waste from and against any and all damages, penalties, fines and liabilities resulting from, arising out of or related to such excluded materials as described herein.
The flat-rate bin rental includes up to one tonne of disposal weight and a seven-day rental period starting on the selected drop-off date. Customers do not select a pickup date during checkout and are responsible for requesting pickup within seven calendar days. If pickup is not requested within that period, additional rental fees may apply beginning on the eighth calendar day. Disposal weight over one tonne may also be subject to additional charges.
The flat rate bins have different maximum weight allowances. 6yard= 1Tonne, 10yard=1.5Tonnes, 14yard=2Tonnes, 20Yard=3Tonnes, 40yard=5Tonnes. Any weight beyond the maximum limit is subject to additional charges based on $120/tonne.
By Accepting this Rental Agreement the lessor and the lessee have mutually agreed upon the terms and conditions of this rental agreement and it is further understood that the following: 1: Lessee agrees and acknowledges that he has received the above equipment in good operating condition and fully understands the correct operational use of equipment. 2: Lessee agrees that the equipment will be returned in the same condition as was received. 3: Lessee agrees to pay for all cleanup and repairs for damages while the equipment is in his possession. 4: Lessee agrees that if the equipment becomes unsafe or in disrepair as a result of normal use, to notify lessor who will effect repairs or subject to availability, replace the equipment with similar equipment in good working order. Lessor will not be responsible for any incidental or consequential damages caused by delays or otherwise. 5: Lessee is responsible to insure the equipment while in his possession. Lessee must verify insurance policy. 6: Lessee agrees to indemnify and hold harmless Mr. Waste Inc. from all claims for compensation in respect to any damage to property or injury to or death of any persons caused by or resulting from lesseeâs operation or from the leased or rented equipment. PLEASE NOTE Lessee is responsible for clean up charges, repairs due to abuse or neglect, cleanup from paint overspray and other spray materials, return of all equipment components accessories, and general appearance of equipment.
